MOX Enterprises, Inc. supports ending the violence and human rights violations in the mining of certain minerals from Democratic Republic of the Congo (DRC) and surrounding countries. As a result the U.S. Securities and Exchange Commission adopted final rules to implement reporting and disclosure requirements related to “conflict minerals,” as directed by the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010. The rules require manufacturers who file certain reports with the SEC to disclose whether the products they manufacture or contract to manufacture contain “conflict minerals” that are “necessary to the functionality or production” of those products.
The definition of “conflict minerals” refers to gold, tin, tantalum and tungsten, regardless of where they are sourced, processed or sold. We support these requirements to further the humanitarian goal of ending violent conflict in the Democratic Republic of the Congo (DRC) and in surrounding countries, which has been partially financed by the exploitation and trade of “conflict minerals”. Mox expects its suppliers to adopt a similar policy and to meet the expectations set out below.
Mox Enterprises, Inc.’s Expectations for Suppliers.
- Supply “DRC Conflict Free” materials. Under MOX’s conflict mineral’s policy, suppliers are expected to supply materials to us that are “DRC conflict free,” which means any materials necessary to the plating of customer supplied parts must not directly or indirectly fund armed conflict in the DRC or adjoining countries.
- Adopt conflict minerals policies. Suppliers to MOX must adopt a policy regarding conflict minerals consistent with our policy, implement management systems to support compliance with their policy and require their suppliers to take the same steps.
- Send EICC reporting templates to their suppliers, and complete MOX’s EICC template. MOX suppliers are expected to pass the EICC public Conflict Minerals Reporting Template to their suppliers and successively upstream until the smelter is identified. The survey information must then be passed back down through the levels of the supply chain to MOX’s direct.
